Get in Touch with Our Immigration Lawyers Serving the Charlotte, North Carolina Immigration Court to Safeguard Your Rights

Contact us today if you or someone you know needs legal assistance with obtaining asylum, withholding of removal or convention against torture. Our law firm will help you present a claim for withholding of removal to a country where your life or freedom could be threatened based on race, religion, nationality, political opinion, or membership in a certain group.

To make things simple, we will first schedule  a free 30-minute initial consultation during which you can discuss your immigration matter directly and confidentially with an attorney who can advise you on what needs to be done to achieve your objectives. Aside from one-on-one meetings, we also offer consultations via telephone and Skype and/or Yahoo Messenger!

Asylum

Those who seek asylum must be outside of their home country and currently in the United States.

Asylum seekers fear persecution by the government in their native country, have either been harmed or fear being harmed by parts of that government, such as right-wing or left-wing groups or political zealots, or have been adversely affected because of their race, religion, nationality, political opinion, or social group. Ideal candidates for asylum  do not pose a threat or danger to United States society by having committed aggravated felonies or war crimes.

Even though you can apply for asylum within the US, you may not be accepted if you have been convicted of a serious crime elsewhere, have been party to the persecution of others, or pose a security threat. If you file a fraudulent application for asylum which is then  discovered by the immigration judge, you may lose your right for any type of relief and will usually be deported.

Therefore, it is best to consult with a Charlotte immigration lawyer if you have any questions about applying for asylum. We at Johnson & Nicholson will be glad to guide you in the right direction.

Withholding of Removal

A person who is approved under ‘Withholding of Removal’ cannot be deported to his or her native country where his or her life or freedom is threatened because of their  race, religion, nationality, membership in a certain group, or political opinion.

To obtain this status, you must demonstrate that a clear probability exists that you will be persecuted if you are forced to return to your native country. However, please note that this status does not make you eligible for a green card. It also means that you may be deported to another country that will accept you ( in the event that such location is found).

In order to submit the strongest application for asylum or withholding of removal, it is important that you have a capable attorney handling your case who knows the ins and outs of how the legal system works. And that’s where we can help you.

The attorneys at Johnson & Nicholson can make a difference in the outcome of your case with personalized attention and our experience in such matters.
